Business Investor's Visa

What is a Business Investor's visa?

Within the British Immigration rules and regulations (Immigration Act 1971, section 6), a person can apply for this visa if they can prove that they:
  • Have at least 200 000 pounds of their own money held under their own name (not a trust) and control. This amount should be disposable and intended for investment in the UK
  • Have sufficient funds to maintain and accommodate themselves until the business provides them with an income
  • Will be actively involved full-time in trading or providing services
  • Have a level of financial investment that will be proportional to their interest in the business
  • They will have either controlling or equal interest in the business
  • They will be able to bear their liabilities
  • There is a need for the investment and services in the UK they will not intend to supplement their business activities by taking or seeking employment in the UK
  • Holds a valid UK entry clearance
Joining an Existing UK Business...
If you are joining as a partner or director to an existing business in the UK you need to prove in addition to the above requirements the following:
  • A written statement of the terms on which you are to take over or join the business
  • Audited accounts for the business for previous years
  • Evidence that their service and investment will result in a net increase in employment, thus create at least 2 new full time jobs
Note that if you do not fall within these rules, you cannot apply for this visa. Since you have decided to migrate to the UK, possibly permanently, the British Immigration Service has every intention to ensure that you are eligible and to confirm you have sufficient funds to support yourself and that your intention is to gain employment. Ultimately, the objective is to show that you will be conducive to the public good

How long is a Business Investor Visa valid?

After being granted your business visa, you have 6 months to enter the UK. The visa is valid for a 12-month period. After this, one can extend the visa for a three-year period. After living in the UK for four years, you can apply for the next visa called Indefinite Leave to Remain as long as you haven't spent 90 days or more away from the UK at a time. After remaining on this visa for two years, you can apply for a British passport.
