Fiancé Visa

What is a Fiancé Visa?

You can apply for a Fiancé visa if you are engaged to:
  • An Australian Citizen
  • An Australian Resident
  • An eligible New Zealand citizen
Further requirements are as follows:
  • You genuinely intend to marry your Fiancé within 9 months from the date you are granted a visa, and intend to live with your partner as their spouse
  • AND you and your Fiancé have met and are personally known to each other
  • Both parties are 18 and over
A Three-step Process:
  1. Prospective Marriage Temporary Visa - involves assessment of your eligibility for a temporary visa. You may be asked to attend an interview. You will also be asked to undergo a medical examination and provide character clearances. This is valid for 9 months. Within those 9 months, you must travel to Australia, marry your fiancé, and apply for the spouse temporary and permanent visas in Australia.
  2. Spouse Temporary Visa - only begins when you apply in Australia and after your marriage. You will be required to complete the relevant forms, pay the required charge and provide evidence that your marriage has taken place and is genuine and continuing. You and your spouse may be asked to attend an interview. This visa is granted until a decision is made on your permanent visa.
  3. Spouse Permanent Visa - This stage of processing will begin approximately 2 years after you lodged your application for spouse temporary and permanent visas and involves an assessment of your eligibility for permanent visa. This includes providing evidence that the relationship is genuine and continuing, a police clearance if you have lived in Australia for more than a year, and an interview. If you meet these requirements, you will be granted a permanent visa.
What if relationship ends before the third stage of processing?
Report this to the Department immediately. You may still be eligible for a permanent visa, waiving the normal two-year waiting period if:
  • After entering Australia and marrying, the relationship breaks down and you/family member are the victim of domestic violence committed by your spouse.
  • After entering Australia and marrying, the relationship breaks down and your and your Australian spouse have children under the age of 18.
  • Your spouse dies.
